The petitioner is accused in connection with Itarhi P.S. Case No. 150/2015 registered under Sections 302/201 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that from the FIR it would appear that one unknown male dead body was recovered nearby the house of Gaya Sah, father of the petitioner. Later on, the dead body was identified as Ranjan Kumar Kharwar @ Jitendra Kharwar of village Churamanpur and the police got recorded the confessional statement of Gaya Sah, Vimlesh Sah @ Vimlesh Gupta, brother of the petitioner and this petitioner showing the involvement in the murder of Ranjan Kharwar. Moreover, on the basis of statement of Gaya Sah and Lal
Patna High Court Cr.Misc. No.57532 of 2015 (3) dt.17-02-2016 2/2 Keshwar Gupta @ Lal Keshwar Sah one country made pistol was recovered near the Sisam tree situated in front of house of Bablu Lal. Except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. It is further submitted that the petitioner having no criminal antecedent is in custody since 22.06.2015.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Itarhi P.S. Case No. 150/2015. Out of two sureties, one surety must be the close relative of the petitioner.
