JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 506 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the informant working as Clerk in Additional Primary Health Centre, Mahdah where the informant was being assaulted on 18.9.2015 for which he gave written report to SC/ST police station on 20.9.2015. The petitioner being Health Manager came and abused the informant. It is submitted by the learned counsel for the petitioner that the petitioner being Incharge, Health Manager, directed the informant to perform his duty hence as retaliatory measure the
Patna High Court Cr.Misc. No.10409 of 2016 (2) dt.04-03-2016 2/2 accusation has been levelled though a complaint was made against the informant before authorities by the petitioner on 19.9.2015. It is further submitted that for the occurrence of 18/20.9.2015 the FIR was registered on 28.11.2015.
Considering the delayed nature of accusation and the petitioner being lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar SC/ST P.S. Case No.33 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
