JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 09-02-2016 Heard learned counsel for the petitioners as well as learned APP for the State.

Informant had alleged that while he along with his son were returning from farm, all the accused so named therein along with others having been variously armed with, chased them and during course thereof, also made indiscriminate firing.

Furthermore, Yodha Rai and Matar Rai shot at his son, Alha Paswan who died instantaneously.

Furthermore, Saryug Pandit, Raman Pandit Sachhu Rai have also sustained injuries at their end. There happens to be complete absence of specific allegation against the petitioners. The instant case stands on similar footing of other co-accused who have already been granted bail at an earlier occasion vide Cr.Misc. Nos.

33358/2013, 40447/2013, 4505/2014, 7582/2014,

Patna High Court Cr.Misc. No.58593 of 2015 (3) dt.09-02-2016 28071/2014, 30270/2014, 18463/2015 and 48357/2015. Accordingly, petitioners namely, Shambhu Sah and Sabha Rai are directed to be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of SDJM, Sikarahana at Dhaka, East Champaran in connection with Ghorasahan (Lakhaura) PS Case No. 148/2013.
