JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 Heard learned counsels for the petitioner and the State. The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Section 20 of the NDPS Act.

It is alleged that 95 kilograms of ganja were recovered from the vehicle which was being driven by the petitioner. A report was called for from the court of the learned Additional Sessions Judge - I, Jamui with regard to the stage of the case and the period likely to be taken in concluding the trial. The report of the learned trial court at Flag - A dated 19.2.2016 does not stipulate the specific period under which the trial is likely to be concluded. Since there are nine chargesheet witnesses out of which four have been examined but it does not

Patna High Court Cr.Misc. No.641 of 2016 (3) dt.02-03-2016 2/2 depict that after framing of charge on 1.4.2013 when the four witnesses were examined and more particularly, when the last witness was examined and as to why the case is pending since so long.

The learned trial court is directed to transmit a report in consonance to the order of this court.

Considering the commercial quantity of recovery, this court is not inclined to grant bail to the petitioner in connection with NDPS Case No. 1 of 2013 arising out of Chakai P.S. Case No. 78 of 2013 pending in the court of learned ADJ - I, Jamui. This application is, accordingly, dismissed. However, it is expected from the learned trial court to expedite the trial and conclude the same, preferably, within a period of six months. (Dinesh Kumar Singh, J) Anil/- U T
