Petitioner is languishing in custody for the offences punishable under Section 120B of the Indian Penal Code and Sections 7, 13(2) read with 13(1)(d) of the Prevention of Corruption Act.
Petitioner is in custody since 16.11.2016. Allegation against the petitioner is that he demanded bribe of Rs.75,000/- from co-worker to relieve him to join on the promotional post. On trap, Rs.20,000/- was recovered from the Almirah inside the room of the petitioner.
Submission of the petitioner is that the petitioner was no authority for selection and posting on the post of T.E. on
Patna High Court Cr.Misc. No.10931 of 2017 (6) dt.25-04-2017 which the informant claims to have been selected. Hence, whole allegation is false and frivolous one. Just due to trivial dispute, the petitioner was trapped in the false case.
Learned counsel for the CBI submits that there is ample evidence that the petitioner accepted the bribe and that was recovered on trap.
Considering the nature and seriousness of allegation, I am not inclined to enlarge the petitioner on bail. Hence, his prayer for bail in connection with Spl. Case No.8 of 2016, arising out of R.C.No.20A/16, pending in the court of learned Spl. Judge, CBI-III, Patna is refused.
The learned Special Judge is directed to expedite the trial.
