JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report on the accusation that they along with other FIR named accused persons assaulted the informant, her son as well as her father-inlaw. The statement of injured, Puran Paswan has been recorded by the I.O. at paragraph-26 of the case diary and the aforesaid injured, specifically, stated that it was co-accused Pappu Singh, who gave Lathi blow to injured Niwas Kumar, causing head injury to him and it was co-accused, Munna Singh, who assaulted him by means of Lathi as a result whereof, he sustained injury. The statement of injured Niwas Kumar has not been recorded by the I.O. in course of investigation. Moreover, co-accused, Munna

Taking note of the aforesaid fact as well as this aspect of the matter that no specific overt act has been attributed against these petitioners, let these petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Jamui P.S. Case No. 233 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Jamui.
