Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Siwan Town P.S. Case No. 230 of 2022 lodged under Sections 25(1-b)a, 26 of the Arms Act.

As per the prosecution case, recovery of desi katta and one live cartridge have been made from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner is in custody since 19.04.2022 having one criminal antecedent in which he is on bail. Charge sheet has already been filed in this case.

Patna High Court CR. MISC. No.37839 of 2022(2) dt.30-09-2022 2/2 Learned counsel for the State opposes the prayer for bail and submits that the custody of the petitioner is very less and he is in custody since April only.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but he is on liberty to move for bail after 6 months from today.

The Trial Court is directed to release the petitioner on bail on its own condition so that he may not evade from trial after the said period.

With this observation, the bail application stands rejected.
