JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This application, for grant of anticipatory bail, arises out of Fatehpur P.S. Case No. 17 of 2019, disclosing offences under Sections 420, 467, 468, 471/34 of the Indian Penal Code. Prosecution case is that the informant went to withdraw the money from SBI ATM kiosk and just after him two boys also entered inside the ATM kiosk and when informant tried to withdraw the money, the same could not be withdrawn and when he turned back to come out from ATM, he saw one of the boy inserted a white colour ATM card into the machine and the informant suspected that they are member of gang operating near ATM and the informant apprehended them, however, one of them succeeded in fleeing away and the apprehended person disclose the name of petitioner.
Submission of learned counsel for the petitioners is
Patna High Court CR. MISC. No.34902 of 2019(3) dt.07-08-2019 2/2 that petitioner has no criminal antecedent and he has been made accused only on the basis of suspicion as well as on confession of co-accused and further there is no withdrawal of money from the account of informant.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -X, Gaya, in connection with Fatehpur P.S. Case No. 17 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
