The petitioner apprehends his arrest in connection with Khaira P.S. Case No. 179 of 2020, registered under Section 376 of the Indian Penal Code and Section 4/6 of the POCSO Act, pending in the court of the learned Additional Sessions JudgeII-cum-Special Judge, POCSO, Saran at Chapra. The accusation is that informant Smita Kumari was residing along with her two children at her Myaka, as her husband had gone outside for livelihood. Patna High Court CR. MISC. No.34610 of 2020(3) dt.22-06-2021 2/2 informant made query on which she informed that Ritu Raj Singh @ Ritik Singh @ Ritu Raj (Petitioner) has used her sexually. Thereafter, on 01.07.2020, the informant went at the clinic of Dr. Kavita at Barauni, who told that this girl has been used sexually.
Learned counsel appearing on behalf of petitioner submits that petitioner is the relative of the informant and due to petty dispute, the informant managed to implicate the petitioner with false allegation.
From perusal of the case diary, it appears that the age of victim is 09 years and she has been raped by the petitioner on several occasions.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, his prayer for grant of pre-arrest bail stands rejected.
