The petitioner being the father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant by causing burn injury for nonfulfillment of rupees five lakhs and disposing of the dead body. It is submitted by learned counsel for the petitioner that the marriage was performed in 2002. The victim has a son of 8 years and a daughter of 2 years. Hence, the case does not come within the purview of Section 304B of the IPC.

Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Madhepur P.S. Case No. 20 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
