The petitioner apprehends his arrest in connection with Bochahan P.S. Case no.218 of 2015 registered under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that in the night of 23/24.11.2015 the informant Vinod Rai was sleeping on the mat in his house, all of a sudden one person came and shot fire at his left palm in which he sustained injury. When he came out from his house then he fell down on the earth and become unconscious and he could not identify the person, who shot fire at him but before few days some dispute was arose regarding land in between the informant and his uncle (petitioner) at that time he had asked to got shot fire at him. Learned counsel for the petitioner submits that there is land dispute in between the informant and petitioner, who is the uncle
Patna High Court Cr.Misc. No.9881 of 2016 (2) dt.22-04-2016 2/2 of the informant and mere on suspicion, the name of the petitioner has been implicated in this case by the informant. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anand Kumar Srivastava, Addl. Chief Judicial Magistrate-cumSub-Judge-XI, Muzaffarpur in connection with Bochahan P.S. Case No.218 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
