2. The petitioner seeks regular bail in connection with Madhepura (Ghailarh) P.S. Case No. 1236 of 2024, registered for the offence under Sections 304 & 309(4) of the B.N.S.

3. As per the prosecution case, some unknown criminals were found involved in snatching of motorcycle and mobile phone of the informant.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has not committed any offence. The co-accused Bihari Kumar from whom, the motorcycle and mobile have been recovered, has named the petitioner in his self-inculpatory statement. The petitioner is in custody since 20.07.2025 having three criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that it is a case of snatching for which the petitioner may not be granted bail also he has three criminal antecedents.

6. Considering the gravity of the offence and the fact that the petitioner has three criminal antecedents, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
