Petitioner is not named in the first information report but he has been made accused in this case only on the basis that one co-accused had talked with petitioner through looted mobile. No doubt, petitioner carries criminal antecedent of near about five cases and confessed his guilt before the police but it appears that except the aforesaid material, there is nothing against the petitioner.
