JUSTICE SUDHIR SINGH ORAL ORDER 17-05-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Sono P.S. case No.07 of 2016 instituted for the offence under Sections 121, 121(A), 120B of the Indian Penal Code as well as Sections 3⁄4 of the Explosive Substance Act and Sections 16, 17, 18, 19 and 20 of the U.A.P. Act, pending in the court of Sessions Judge, Jamui. The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is a naxal activist and incriminating articles were said to have been recovered from his possession. A report was called for from the Trial Court. It has been reported that the case is at the stage of argument and the trial is expected to be concluded within a period of two months.
Patna High Court Cr.Misc. No.16698 of 2017 (3) dt.17-05-2017 2/2 Considering the aforesaid facts and circumstances and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.
