JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-08-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the respondents. The petitioner has filed the present writ petition for a direction to the respondent-University to grant one grace mark to the petitioner in her theory paper IV as she failed in that paper by one mark.

The issue of grant of grace marks is within the realm of the University and the Court does not feel persuaded to grant any indulgence to the petitioner.

However, liberty shall be available to the petitioner to approach the University for consideration of her hardship and

Patna High Court CWJC No.13338 of 2018(4) dt.16-08-2019 2/2 awarding of one grace mark which shall be considered by the University without being prejudiced by any observation as academic decisions are taken by the University maintaining the excellence of education and the Court is not expected to interfere with the same. It is only for the University to consider the hardship of the petitioner.

The University while taking decision shall consider the case of the petitioner sympathetically as it may have telling effect on the future prospect of the petitioner. With the aforesaid liberty, the writ petition stands disposed of.
