JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 18-04-2019 The petitioner has approached this Court for a direction to the District Magistrate, Kaimur for revocation of his suspension, which order was passed by him on 05.07.2018 for the petitioner having absented himself from the meetings held by him.

2. It has been submitted on behalf of the petitioner that charges against the petitioner was framed on

Patna High Court CWJC No.13315 of 2018 dt.18-04-2019 2/3 24.10.2018. The petitioner was asked to submit his explanation within twenty four hours on 26.06.2018. The petitioner is stated to have submitted his explanation on 29.06.2018 with an explanation of there being a holiday for the birthday of saint Kabir.

3. For the moment, this Court would not appraise the correctness of the order passed by the District Magistrate, Kaimur, suspending the petitioner and initiating a departmental proceeding against him for his having absented himself from official duties for two days.

4. Nonetheless, considering such charges to be not very serious with respect to the conduct of a government servant, it is expected that the departmental proceeding shall be concluded within a period of three months from the date of production of a copy of this order. Should the departmental proceeding be not concluded within the aforesaid period, the District Magistrate, Kaimur shall consider revoking the suspension of the petitioner and pass orders accordingly.

5. With the aforesaid observation/direction, the writ
