JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This application has been filed for modification of order dated 08.04.2019 passed in Cr. Misc. No. 57267 of 2018, by which, the prayer of the petitioner for grant of pre arrest bail has been disposed of with direction to the petitioner to surrender within a period of six weeks and it was directed that if the petitioner is ready to settle the dispute with the informant, the same shall be considered by the court below and after considering all aspects of the matter, the court below will pass an appropriate order.

It has been submitted by learned counsel for the petitioner that petitioner is ready to deposit the amount in dispute, if some reasonable time is allowed.

Heard learned APP as well as learned counsel for

Patna High Court CR. MISC. No.34161 of 2019(2) dt.21-06-2019 2/2 the informant.

Considering the fact that his prayer for anticipatory bail was disposed of and he was directed to surrender in the court below but he did not surrender and has now come for modification of the order, as such, I am not inclined to interfere with the order dated 08.04.2019 passed in Cr. Misc. No. 57267 of 2018.

The petitioner, if so desire, may surrender and pray for regular bail and if such a submission is made before the court below, the court below shall consider the same and dispose of the matter on its own merit.

With the above observation, this application is dismissed.
