The petitioner is languishing in custody since 06.03.2019 in a case registered for the offences punishable under Sections 411, 379, 413 and 414 of the IPC.

It is alleged that from the house of the petitioner, one stolen motorcycle was recovered.

It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that recovery has been made from the house of the petitioner.

Considering the nature of accusation and period under

Patna High Court CR. MISC. No.34381 of 2019(2) dt.27-05-2019 2/2 custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 179 of 2019.
