JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dumaria P.S. Case No. 15 of 2016 registered for the offence punishable under Sections 409/34 of the Indian Penal Code.

Prosecution story as per written report of Block Education Officer is that the Panchayat Secretaries of several Panchayats were directed to submit the file regarding appointment of Panchayat Teachers but they were not submitting the same and petitioner is one of them. Submission of learned counsel for the petitioner is that the appointment has been made in the year 2003 and he has stated in paragraph-8 of the petition that he has already deposited the documents in the year 2016.

In view of above facts and circumstances, let petitioner, in the event of surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Gautam Kumar, Judicial Magistrate, 1st Class, Gaya, in connection with Dumaria P.S. Case No. 15 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in the investigation and appear before the I.O. as and when required, otherwise his bail bonds shall be cancelled.
