The petitioner is languishing in custody for the offence punishable under Sections 366A and 120B of the Indian Penal Code.
Petitioner is in custody since 19.09.2019.
Allegation is that petitioner and his parents kidnapped to the minor daughter of the informant to pressurize her for compromise in earlier case no. 122 of 2018.
In the statement recorded under Section 164 Cr.P.C., the victim stated that her father had lodged a case of rape against the petitioner said to be committed against the victim
Patna High Court CR. MISC. No.34297 of 2020(3) dt.08-02-2021 2/3 girl in the past. The petitioner was pressurizing for compromise of that case. The petitioner called on the victim near Patania chowk. The victim went there voluntarily. The petitioner asked for compromise of that case and proposed for marriage. The victim refused and thereafter the victim married with a driver on the proposal of the driver to marry. She was living along with the driver. In the meantime, the police came to the house of the driver Sanjay Rai and took the victim along with them. The statement of the victim reveals that she was a consenting party to the relationship with the petitioner because no one would voluntarily go to a lonely place on call by her rapist.
Considering the facts aforesaid as well as completion of the investigation of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Biraul P.S. Case No. 80 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial

(c) The petitioner shall not leave the country without permission of the trial Court.
