ANJANA MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 06.10.2015 in connection with Chautarwa P.S. Case No. 264 of 2015, registered for offences punishable under Section 147, 148, 149, 326, 307, and 109 of the Indian Penal Code and Sections 25(1-B)a, 26, 27, 35 of the Arms Act.

Learned counsel for the petitioner submits that although there is an allegation that petitioner having fired, yet the said fire did not hit anybody much less the informant. It is further submitted that save and accept general and omnibus allegation made, there is no further cogent material in the case dairy to

Patna High Court Cr.Misc. No.197 of 2016 (3) dt.05-02-2016 2/2 connect the petitioner.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that the petitioner was one of the members of the gang, who attacked the informant, however, no injury is said to have been inflicted by the petitioner as per the materials available in the case diary.

Considering the aforementioned facts and circumstances and that there is no specific allegation against the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate -I, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 264 of 2015.
