The petitioner apprehends his arrest in a case registered for the offence under Sections 399/402 of the Indian Penal Code and Sections 25/26/35 of the Arms Act. As per F.I.R., four unknown miscreants, on the point of pistol, looted three T.V. and two mobile phones from shop of informant.

It is submitted on behalf of petitioner that name of the petitioner transpired during course of investigation. No incriminating article has been recovered from conscious possession of the petitioner.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has got one criminal antecedent of similar nature and in the said case, this petitioner was arrested on spot alongwith other co-accused while committing loot.
