The petitioners are languishing in custody since 06.03.2019 in a case registered for the offences punishable under Sections 379, 411, 413 and 414 of the IPC.

It is alleged that from the house of each of the petitioners, one stolen motorcycle was recovered.

It is submitted by learned counsel for the petitioner that recovery has not been made from the conscious physical possession of the petitioners and the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal

Learned APP that recovery has been made from the house of the petitioners and they are named in the FIR. Considering the nature of accusation, investigation being already concluded and the period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Araria in connection with Araria P.S.
