JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Naubatpur P.S. Case No. 419 of 2018 registered for the offences punishable under Sections 3(3), 4, 5, 7, 35(a) of Fertilizer Control Order and Section 7 of E.C. Act. Prosecution story is that petitioner is shopkeeper and is selling fertilizer on more value and on inspection he has not shown the stock register, cash memo and invoices and when public assembled there he fled away.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted, which will appear from the fact that raid was conducted on 28.8.2018 and FIR was registered on 4.9.2018 and there is no seizure list or any other material in support of the allegation. Heard learned APP also.

No.34387 of 2019(3) dt.21-08-2019 2/2 In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Danapur, District Patna, in connection with Naubatpur P.S. Case No. 419 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
