The petitioner has challenged grant of licence in favour of respondent No. 5 to run a Fair Price Shop under Bihar Targeted Public Distribution System (Control) Order, 2016 and is seeking a direction to grant the said licence in favour of herself. The petitioner has questioned the legality of the process
Patna High Court CWJC No.10646 of 2020(3) dt.17-01-2022 2/2 of selection for grant of the said licence adopted by the respondents.
As the petitioner has alternative remedy, this application is disposed of with an observation that the petitioner shall have liberty to approach appropriate/statutory authority by raising grievance as raised in the writ application. If she does so within four weeks from today, the Court expects that the appropriate/statutory authority shall consider the petitioner's grievance and dispose it of within three months thereafter. The petitioner shall be at liberty to seek condonation of delay before the appropriate/statutory authority by making an application. The said authority shall consider any application for condonation of delay keeping all relevant aspects including the fact that the petitioner was pursuing her remedy before this Court by filing present writ application.
