Petitioner is not named in the first informant report nor has been put on Test Identification Parade. The name of petitioner came in this case in confessional statement of co-accused, Vishal Kumar. The petitioner carries criminal antecedent of two cases and submission on behalf of petitioner is that having similar allegation, one co-accused namely, Bittu Kumar has already been granted privilege of bail by the learned court below but the same court rejected the prayer for bail of the petitioner. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.
