JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner, the as well as learned Additional Public Prosecutor for the State. Also heard the injured who appeared himself and argued his case. Petitioner is not named in the first information report but admittedly, the informant is not an eye witness of the alleged occurrence and the informant lodged the present case on the basis of information, gathered by him from the eye witnesses. Moreover, the statement of injured has been recorded at paragraph-24 of the case diary, in which, he stated that the petitioner opened fire but the firing did not hit him and, thereafter, other accused made firing causing fire-arm injury. The injured stated that his fardbyan was recorded in PMCH, Patna and in the aforesaid fardbyan, he specifically, stated
Patna High Court Cr.Misc. No.720 of 2016 (3) dt.17-02-2016 that it was the petitioner, who caused fire-arm injury on his abdomen.
Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of the fact that petitioner is in jail custody since 10-06-2015 and investigation against him has already been completed, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Haspura P.S. Case No. 164 of 2013 to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad.
