2. The accused/petitioner is named in the FIR and apprehending her arrest in connection with SKP P.S. Case No.288 of 2025 registered under Sections 318(3), 322, 338, 336(3), 316(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (in short 'BNS').
3. As per FIR, allegation against named coaccused persons Anand Pratap Singh and his wife Anuradha Singh cheated the informant for a sum of Rs. 92,16,000, for a shop, situated on the first floor of R.C. Western Mall, Arya
2/4 Samaj Road, Saguna More, Patna.

Mr. Rajesh Kumar Singh, learned senior counsel appearing on behalf of the petitioner submitted that the entire allegation can be gathered only against co-accused persons, namely, Anand Pratap Singh and his wife Anuradha Singh from the face of FIR, where nothing incriminating stated against Archana Singh(petitioner). It is submitted that due to suspicion as this petitioner is the sister of main coaccused, Anand Pratap Singh, she was implicated with present criminal case, without having any cogent materials. It is submitted that co-accused Anand Pratap Singh, under compromise, now ready to return the amount of Rs. 92,16,000/- which he received from this informant and out of that, he already paid Rs. 35 Lakh till now to the informant and for the rest of Rs. 57,11,000/-, he is in process to pay and considering the aforesaid aspects, the main co-accused, namely, Anand Pratap Singh was granted regular bail by learned trial court. While concluding the argument it is submitted that the dispute is primarily civil in nature for which present criminal prosecution is completely
3/4 unoccasioned and unwarranted and, moreover, petitioner is a lady of clean antecedent.

Learned APP duly assisted by Mr. Nishant Raj Nama, learned counsel appearing on behalf of informant while opposing the prayer of bail submitted that this petitioner was involved actively in alleged shop deal. In support of his submission, learned counsel drawn the attention of this Court towards the page no. 5 of impugned order, where prayer of anticipatory bail of this petitioner was rejected by learned trial court referring some role qua petitioner referring para no. 62 and 65 of the case diary.

In view of aforesaid factual submissions and by taking note of fact as prima facie nothing incriminating appears speaking against this petitioner except arraying her an accused with FIR coupled with the fact that the disputes primarily appears civil in nature, where under compromise, the main co-accused already returned Rs. 35 lakh out of total received Rs. 92,16,000, accordingly, the petitioner, above-named, who is a lady of clean antecedent, is directed to be released on bail, in the event of her arrest or surrender
4/4 in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of S.D.J.M., Patna, in connection with SKP P.S. Case No.288 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
