In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 409, 419, 467, 468 and 471/34 of the I.P.C.
It is submitted that for the same allegation, i.e. withdrawal of Rs. 4,35,000/- Baroon P.S. Case No. 91 of 2012 has been registered under sections 409/34 I.P.C. wherein also the petitioners are accused and they had been allowed regular bail. In that case the Complainant of this case is also an accused and as such the petitioners for the same offence cannot be harassed twice,
Patna High Court Cr.Misc. No.28641 of 2014 (4) dt.08-04-2015 2/2 to which the learned A.P.P. duly assisted by the learned counsel for the Complainant is not in a position to say otherwise. In the facts and circumstances as stated above, the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. Sri B.K. Pathak, J.M. Ist Class, Aurangabad in C.R. No. 167 of 2012, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
