JUSTICE SUDHIR SINGH ORAL ORDER 02-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Natwar Town P.S. Case No.53 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 427 and 379 of the Indian Penal Code. The prosecution case, in brief, is that the informant Khurshid Alam runs the business of vending meat. The neighbor Dabloo Miyan and Prince Miyan also vend the meat. There was altercation between them over vending the meat. Due to said altercation on 07.09.2015 Dilshad Miyan @ Bhola, Prince Miyan, Gora Miyan, Dabloo Miyan assaulted on the head of Naushad

Patna High Court Cr.Misc. No.11331 of 2016 (2) dt.02-05-2016 2/3 Miyan inflicting head injury to him by means of sword and knife. Sustaining injury he fell senseless and he was rushed to Dinara Hospital, Irshad Miyan, Nagma Khatoon, Chand Tara also arrived there armed with deadly weapons, Nagma Khatoon assaulted on the head of Khurshid Alam by means of knife inflicting head injury to him while Irshad Miyan assaulted on both hands of Islam Miyan by means of dagger and made him injured, Chand Tara took away Rs.5,000/- from his cash box.

It is submitted on behalf of the petitioners that the petitioners have falsely been implicated. There is a case and counter case between the parties. Both the sides are said to be injured in course of occurrence for a petty dispute. The injury received by the petitioners has not been explained by the prosecution.

On behalf of the State and the counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of
