Petitioner is in custody in connection in Mufassil P.S. Case No. 99 of 2019 for the offence under sections 272, 273, 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case total 135 liters of country made liquor was seized from the bank of the river and not from the conscious possession of the petitioner.

Learned counsel for the petitioner submits petitioners have no criminal antecedent and he is in custody since 15.03. 2019.

No.34518 of 2019(2) dt.27-05-2019 2/2 Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari, in connection with Mufassil P.S. Case No. 99 of 2019.
