The petitioners seek bail in connection with Sursand P.S. Case No. 217 of 2020 instituted for the offences under Sections 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016.

From the perusal of the F.I.R., it appears that 70.2 litres of liquor was recovered from the possession of the petitioners.

The motorcycle though is said to belong to

Patna High Court CR. MISC. No.34529 of 2020(2) dt.21-12-2020 2/2 petitioner no. 2 but the recovery, it has been urged has wrongly been saddled upon the petitioners.

The petitioners are in custody since 25.07.2020 and are persons of clean antecedents.

Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -II-cum-Special (Excise), Sitamarhi, in connection with Sursand P.S. Case No. 217 of 2020 .
