The petitioner seeks bail in Rafiganj P.S. Case No. 114 of 2013 dated 01.06.2013 instituted under Sections 395 of the Indian Penal Code.

This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 29.08.2014 in Cr. Misc. No. 9272 of 2014.

Initially, a report was called from the Court below with regard to status of the case and reason why the trial was not concluded. Pursuant to it, a report dated 23rd April, 2016 was received stating that the trial was likely to be concluded within six months. The second report dated 20th July, 2016 from the Additional

Patna High Court Cr.Misc. No.15276 of 2015 dt.02-09-2016 2/2 Sessions Judge, VI, Aurangabad reiterates the fact and states that it was expected to be concluded within the time frame. As only two months remain for the period to expire, this Court is not inclined to consider the prayer for bail of the petitioner. Accordingly, the application stands dismissed. However, the Court below shall ensure that the time indicated by it twice in its communication to the Court earlier of concluding the trial within six months is complied with positively, failing which this Court shall be constrained to take a strict view in the matter.
