JUSTICE SANJAY PRIYA ORAL ORDER 26-06-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Ara Town P.S. Case No. 739/2018, instituted for offence under Section(s) 302, 387 and 307/34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence petitioner along with other accused persons came at the shop of informant and made demand of Rs. 10 lacs as Rangdari. Brother of informant refused to give money then all the accused persons started abusing. It is alleged that accused Khursid Mian and Naiyar Miya fired indiscriminately on the brother of informant on account of which he sustained several
Patna High Court CR. MISC. No.37894 of 2019(2) dt.26-06-2019 2/2 firearm injuries and died on the spot. It is further alleged that co-accused Babli Mian and Samsher Mian made firing on informant causing injury in his stomach. Another person has also sustained firearm injury.
From the written report, it appears that there is no allegation of specific overt act against this petitioner. Specific allegation of causing firearm injury to the brother of informant is against Khursid Mian and Naiyar Mian.
Learned counsel for the informant has opposed the prayer for bail for petitioner.
Petitioner is in custody since 13.02.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara Town P.S. Case No. 739/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
