BAJANTHRI ORAL ORDER 04-07-2025 The present Contempt Petition is filed belatedly in view of the fact that order dated 17.05.2022 was passed in CWJC No. 6761 of 2022 with certain directions to be completed within a period of three months from the date of receipt of the order dated 17.05.2022. The petitioner had cause of action in the month of September, 2022. On the other hand, he has presented this Contempt Petition in the year 2025. Therefore, in identical matter Division Bench has taken a decision in the case of Dr. Rajesh Kumar Sinha & Ors. Vs. The Union of India & Ors. bearing M.J.C. No. 1840 of 2023 in C.W.J.C. No. 13888 of 2016 read with S. Tirupathi Rao Vs. M. Lingamaiah & Ors.

Patna High Court MJC No.1927 of 2025(3) dt.04-07-2025 2/2 reported in 2024 SCC OnLine SC 1764 while interpreting Section 20 of the Contempt of Court Act read with Article 215 of the Constitution to the extent that beyond one year from the date of cause of action Contempt Petition is not maintainable. Accordingly, the present MJC - Contempt Petition No. 1927 of 2025 stands disposed of as not maintainable.

2. Reserving liberty to the petitioner to file writ petition.
