The petitioner seeks bail in connection with Atri P. S. Case No. 420 of 2019 dated 20.09.2019, instituted for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) (d) of the Bihar Prohibition and Excise Act, 2016.

The name of the petitioner has transpired in the confession of some of arrested accused persons. The allegation against the petitioner and others is of manufacturing liquor in the Jungle. A very small amount

Patna High Court CR. MISC. No.35097 of 2020(2) dt.06-01-2021 2/2 of liquor is said to have been recovered on search. Nothing has been recovered from the personal / constructive possession of the petitioner.

The petitioner is in custody since 16.05.2020. Regard being had to the nature of accusation and the period of custody, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya, in connection with Atri P. S. Case No. 420 of 2019.

The petition stands allowed.
