JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 21.10.2015 in a case registered for the offences punishable under Sections 212,216,399,402 and 414 of the Indian Penal Code, sections 25(1-B) a, 26 and 35 of the Arms Act and sections 20 and 22 of NDPS Act.

On information that the miscreants are preparing to commit dacoity, raid was laid when several persons were arrested with arms and ammunitions. From the possession of the petitioner one live cartridge and mobile were recovered whereas from the place of seizure 1⁄2 Kg ganja was recovered.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.58537 of 2015 (2) dt.04-01-2016 2/2 that ganja was not recovered from the possession of the petitioner and similarly situated accused Dhiraj Kumar has been granted bail vide Cr. Misc. No. 56155 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The investigation has already concluded. Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur in connection with Sadar P.S. Case No. 557 of 2015.
