The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 20.03.2017 passed in Cri. Misc. No. 6334 of 2017, on the ground that the petitioner is suffering in custody since 02.08.2016 but he has not been put on T.I.P. and besides confessional statement there is no other legal and tangible material. Other co-accused namely Suraj Kuamr and Rajesh Kuamr have been allowed bail and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of bail by submitting
Patna High Court Cr.Misc. No.32749 of 2017 (2) dt.09-08-2017 2/2 that on the basis of confessional statement of the petitioner looted silver payal was recovered and further the petitioner has suppressed the criminal antecedent earlier.
In the facts and circumstances stated above, at this stage, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected However, the petitioner may renew his prayer for bail after remaining further six months in custody.
