After some argument, learned Advocate for the petitioner seeks permission to withdraw the present writ petition, in view of the statements made in the 3rd supplementary counter affidavit, filed on behalf of respondent nos. 4 to 6, especially para nos. 4 to 6, wherein the University has informed this Court that the very claim of the petitioner based on parity with that of

Patna High Court CWJC No.12100 of 2019(21) dt.23-09-2024 2/2 husband of late Renuka Sahay has come to an end, as the order granting retiral benefits in favour of the husband of Renuka Sahay has been withdrawn by the University.

3. Learned Advocate for the petitioner further submits that in Contempt matter, as noted in para.6 of the 3rd supplementary counter affidavit, certain directions has been issued.

4. In view of the above, the writ petition stands disposed of as withdrawn with a liberty to the petitioner that in case any fresh cause of action arises, he may be at liberty to file a fresh application.
