The petitioner seeks bail in connection with Mahila P.S. Case No. 63 of 2020, dated 15.06.2020, instituted for the offences under Sections 376, 511, 354(A), 354(B) and 506/34 of the Indian Penal Code, Sections 8 and 12 of the Prevention of Children from Sexual Offences Act, 2012 and Section 67(C) of the

Patna High Court CR. MISC. No.34534 of 2020(3) dt.05-03-2021 2/3 Information Technology Act, 2000.

The petitioner and another are said to have attempted to outrage the modesty of the victim and also of shooting pictures of her.

Learned counsel for the petitioner has submitted that only because of a dispute with the uncle of the prosecutrix, this case has been lodged.

The petitioner is in custody since 16.06.2020. In this case, charges have already been framed but no witness has been examined as yet.

Apart from this, learned counsel for the petitioner has submitted that the age of the victim has been assessed to be more than 18 years, therefore, the provisions contained in Sections 8 and 12 of the Prevention of Children from Sexual Offences Act, 2012 would not apply. However, regard being had to the nature of accusation against the petitioner, I am not inclined to grant bail to him for the present.

The prayer for grant of bail of the petitioner is, accordingly, rejected.
