2. The petitioners seek bail in a case registered for the offence punishable under Sections 87, 137(2), 140(3), 351(2) and 3(5) of the B.N.S.
3. As per the prosecution case, Informant's wife was in love relationship with one Tarkeshwar Thakur, who is alleged to have kidnapped informant's wife. Thereafter, when the informant went to the house of Tarkeshwar Thakur, the petitioners along with co-accused assaulted and threatened him.
4. Learned counsel for the petitioners submits that

No.36508 of 2026(2) dt.11-06-2026 2/3 it would be apparent from the bare perusal of the first information report that the informant is the husband of the victim and he had himself stated that his wife Poonam Devi, aged about 26 years, was in a love relationship with one Tarkeshwar Thakur, aged about 22 years, for the past six months. It has been further stated that on 24.12.2025 his wife had left alongwith said Tarkeshwar Thakur with cash, jewellery etc. with the purpose of marriage. So far as the role of the petitioners are concerned, they happen to be the brothers of the said Tarkeshwar Thakur and the only allegation is that when the informant enquired about his wife, they abused and threatened him. It is thus submitted that the allegation, if any, would be confined to Tarkeshwar Thakur and these petitioners have been implicated in the case only by virtue of they being the brothers of the said Tarkeshwar Thakur. Petitioners are in custody since 23.03.2026 with no criminal antecedent and the investigation is almost on a close.
5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioners on the ground that the victim is still traceless and she has been confined by all accused persons.
6. Taking into consideration the facts and

No.36508 of 2026(2) dt.11-06-2026 3/3 circumstances and also considering the story narrated by the informant himself in the F.I.R. relating love relationship between the victim and one Tarkeshwar Thakur and she having gone voluntarily with him, let the above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bettiah, West Champaran/concerned Court below in connection with Srinagar P.S. F.I.R. Case No. 26 of 2026.
7. However, since the victim is still traceless the Investigating Officer is directed to take all steps for recovery of the victim lady and get her statement recorded. The Superintendent of Police, Bettiah, East Champaran, would himself monitor such recovery.
8. Let a copy of this order may be communicated to the Superintendent of Police, Bettiah, East Champaran through FAX for its compliance.
