The petitioner seeks bail in Kashichak P.S. Case No. 18 of 2021, registered for the offence punishable under Sections 399, 400, 402, 413, 414 of the Indian Penal Code and section 25(A)/(1A)/(1AA)/(1B)/AB/26(1)(2)/35 of the Arms Act. As per the prosecution case, on secret information that some miscreants have assembled to commit dacoity a raid was conducted and three persons with arms and ammuition were arrested who disclosed the name of this petitioner as one of the persons who fled away after noticing the police party. It is submitted on behalf of the petitioner that no arms and ammunition has been recovered from possession of this petitioner. Petitioner has been made accused in this case on the basis of confessional statement of accused persons who were
Patna High Court CR. MISC. No.47042 of 2021(2) dt.18-11-2021 2/2 apprehended by the police on the spot. Petitioner claims clean antecedent and he is in custody since 02.03.2021. Chargesheet has already been submitted.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Nawada in connection with Kashichak P.S. Case No. 18 of 2021.
