In this application for anticipatory bail the petitioners apprehend their arrest for the offence punishable under sections 302, 201/34 of the I.P.C.

At the very out set it is submitted that in this case the police after completing investigation submitted final form against the petitioners and charge-sheet was submitted only against Balbant Yadav, but cognizance has been taken after differing with the view of submission of final form.

The learned A.P.P. fairly submits that against the petitioners final form was submitted finding the allegation not true.

No.29804 of 2014 (3) dt.22-01-2015 2/2 In the facts and circumstances as stated above, the petitioners, namely, Brijdhari Yadav @ Bijaydhari Singh, Jai Prakash Yadav @ Jai Prakash Singh and Ram Pravesh Yadav @ Ram Pravesh Singh, in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Kaimur at Bhabua in Adhaura P.S. Case No. 18 of 2007/ Tr. No. 3380 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
