Petitioner is apprehending his arrest in connection with Chhatapur P.S.Case No.16 of 2019 , registered for offences punishable under Sections 366(A)/120(B) of the Indian Penal Code and Section 4/6 of the POCSO Act.

Allegation against the petitioner who happens to be brother-in-law (Bahnoi of the victim girl) is of kidnapping of the victim girl.

Submission of the learned counsel for the petitioner is that now they have solemnized marriage and she is ready to reside with the petitioner, which will appear from the statement recorded under Section 164 of the Cr.P.C. and in her statement recorded under Section 164 Cr.P.C., she has disclosed

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-Ist, Supaul in connection with Chhatapur P.S.Case No.16 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
