The petitioner apprehends his arrest in connection with Nagar P.S. Case no. 632 of 2015 registered under Section 379 of the Indian Penal Code.
The prosecution case is that informant withdraw cash of Rs.1,00,000/- from the S.B.I, Begusarai main branch and kept the same in the dicky of the motorcycle and parked the motorcycle near the tobacco shop of Mannu Kumar, where petitioner and one Chandan were also present. When the informant came from tobacco shop then found lock of the dicky was broken and the cash of Rs. One Lakh was found missing. The informant raised suspicion against the petitioner and one Chandan having hand in taking the said money from the dicky of the motorcycle.
Learned counsel for the petitioner submits that it would

No.9871 of 2016 (3) dt.29-04-2016 2/2 appear from the F.I.R. that the occurrence is said to happened on 07.11.2015, but the F.I.R. was lodged on 12.11.2015 after delay of five days. The petitioner having no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Nagar P.S. Case No. 632 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
