JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 18-03-2016 After some argument, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present application with a liberty to surrender in the court below within a period of one month from today and seek regular bail on its own merits.

Permission is accorded.

The present application for grant of anticipatory bail to the petitioner in connection with Complaint Case No.2C2 of 2011 pending in the court of learned Chief Judicial Magistrate, Munger stands dismissed as withdrawn with the liberty aforesaid. It goes without saying that, if the petitioner surrenders in the court below within the aforesaid period of one month and applies for regular bail, then the same shall be considered and decided on its own merits by taking into consideration all the materials, which are either available or brought on the record.
