Mr.Sucheta Yadav ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-12-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case

3/4 registered for the offences punishable under Section 147, 148, 149, 341, 342, 323, 324, 307, 386, 332, 333, 427, 353, 504, 506 of Indian Penal Code and Section 3 of Epidemic Act and Section 3⁄4 of Damage to Public Property Act. It is a case of blocking the road after the death of one person, namely, Kishore Das in a road accident. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in the present case. He further submits that they were only members of the mob and petitioners have clean antecedent. It is also submitted that similarly situated co-accused persons have been granted bail by this Court via dated 12.09.2022 passed in Cr. Misc. No. 33506 of 2022. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned CJM, East

4/4 Champaran at Motihari in connection with Sugauli P.S. Case No. 48 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
