JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
The petitioner was apprehended and on search two loaded country made pistol alongwith 12 live cartridges were seized from his physical possession. Furthermore, from para 3 of the petition it is evident that petitioner has got criminal antecedent being involved in four cases since before. It is also apparent that petitioner happens to be under custody since 31.8.2015. From the report received from the learned Lower Court vide letter no. 02/ 13.01.2016 it is evident that charge has already been framed on account thereof, is pending for evidence. The learned Lower Court had also disclosed that trial is expected to conclude within 3 months.
Patna High Court Cr.Misc. No.451 of 2016 (3) dt.16-02-2016 That being so, prayer for bail is rejected. Directing the learned Lower Court to conclude the trial within stipulated period shown in the report itself failing which the learned Lower Court will itself release the petitioner on bail to its own satisfaction.
