Petitioner claims to have retired on 31.12.2013 from the post of Associate Professor, Purnea College, Purnea, a constituent unit of Bhupendra Narayan Mandal University. However, it is contended that though his pension is being paid since February 2015 but his arrear of pension for the period commencing from 01.01.2014 to January 2015 has not been paid. That apart, the gratuity, leave encashment, group insurance etc. have also not been paid.

Patna High Court CWJC No.4007 of 2016 dt.20-05-2016 2 / 2 Accordingly, this writ application is being disposed of with a direction to the respondent no.6, the Registrar, Bhupendra Narayan Mandal University to examine the claim of the petitioner raised in this writ petition and ensure payment of admissible dues along with the statutory interest, if any, against all the heads of post retiral benefits within a period of three months from the date of receipt/production of a copy of this order. If any of the claims or all the claims are not found tenable then a reasoned order would be required to be passed by him, which should be communicated to the petitioner within the aforesaid period. This is further made clear that if admissible amounts are not paid within the aforesaid period then the petitioner would be entitled for payment of simple interest @ 10% per annum on the admissible unpaid amount to be calculated from the date the same became due till the date of its final payment.
