For the Petitioner/s : Mr. Tilak Sao, Advocate For the Opposite Party/s : Mr. U. S. P. Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 13-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner renewed his prayer for grant of bail in connection with Sessions Trial No. 1015 of 2014 arising out of Alamganj P.S. Case No. 212 of 2014 registered under Sections 376(2) (g) of the Indian Penal Code.
The prayer for grant of bail was earlier rejected by this Court vide order dated 02.12.2014.
It would be evident from the earlier order passed by this Court that the petitioner is alleged to have ravished the informant of the case, which fact finds support from the medical evidence and the witnesses examined during investigation have
Patna High Court Cr.Misc. No.449 of 2016 (2) dt.13-01-2016 2 / 2 also corroborated the same.
It has been contended that out of the seven chargesheet witnesses, only three have been examined till date and there is no likelihood of the conclusion of trial in near future. Be that as it may, regard being had to the gravity of the offence and the advanced stage of trial, I find no reason to take a different view of the matter. Accordingly, the application for bail is rejected.
